These terms govern your use of Tabify, a macOS application published by Alon Sabi ("we", "us"). Buying or using Tabify means you accept them. They are written to be read, so they are short.
What you are buying
A personal, non-exclusive, non-transferable licence to use Tabify on any Mac you own, for as long as you like. There is no subscription, no account, and no expiry. You may not resell, sublicense, or redistribute Tabify or your licence key.
Your key carries your name and email address, and Tabify displays them in Settings. Sharing your key means sharing those.
Which versions your licence covers
Your licence covers the major version it was sold for, and every update within it, free and forever. Every point release inside that version costs nothing further. Which major version your licence covers is written into the key itself and signed, so it cannot be changed after the fact by us or by anyone else, and Tabify shows it in Settings.
The next major version may be a paid upgrade. If it is, the version you bought keeps working exactly as it does now, for as long as macOS runs it. We will never disable software you have paid for, and we will never charge you to keep using it.
Refunds
If Tabify is not for you, write within 30 days and you will be refunded. No reason needed. It is a $15 utility and an argument would cost us both more than that.
Who you are buying from
Payments are processed by Stripe, which acts as merchant of record for the sale. Your receipt comes from Stripe and shows Stripe as the seller. These terms govern your use of the software itself. Nothing here affects consumer rights you have under the law where you live, which in some places cannot be waived by an agreement like this one.
What we do not promise
Tabify moves windows belonging to other applications using the facilities macOS provides for that, and it needs the Accessibility permission to do so. Some applications do not cooperate, and Apple may change how those facilities behave in any macOS release.
Tabify is provided "as is", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Tabify will be uninterrupted or error free, that defects will be corrected, or that it will work with every application or every version of macOS.
Limit of liability
To the maximum extent permitted by law, our total liability to you for any and all claims arising out of or relating to Tabify or these terms will not exceed the amount you actually paid for your licence.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, lost time, or business interruption, even if we have been told such damages were possible. This limit applies however the claim arises, and applies even if a remedy described here fails of its essential purpose.
Governing law
These terms are governed by the laws of the Province of British Columbia, Canada, without regard to its conflict of laws rules. Any dispute arising out of or relating to Tabify or these terms will be brought exclusively in the courts of British Columbia, Canada, and you agree to that jurisdiction.
Changes to these terms
We may update these terms, and the updated version will be posted here with a new date at the top. Changes apply to purchases made after they are posted. The coverage your existing licence carries does not change, because it is written into the key itself.
If part of this is unenforceable
If any part of these terms is found unenforceable, that part is limited or removed to the minimum extent needed, and the rest stays in force.
